1. Agreement to Terms

By creating an account or accessing FairyMarketValue.com ("the Service," "the Platform," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use the Service.

FairyMarketValue.com is operated by ChachKey.com. These Terms constitute a legally binding agreement between you and ChachKey.com governing your access to and use of the Platform. By using the Service, you represent that you are at least 18 years old and have the legal capacity to enter into this agreement.

2. Service Description

FairyMarketValue.com is a financial literacy platform designed to help children ages 6–12 learn foundational money concepts through the tooth fairy tradition. The Platform enables parents and guardians ("Parent Families") to create and manage a household profile, record tooth loss events, track contributions from family and friends, and access age-appropriate financial lessons tied to each tooth event.

The Platform also allows grandparents, relatives, and family friends ("Gifters") to participate by pledging and recording contributions to a child's tooth events, reinforcing savings habits and family financial engagement.

3. Account Types

The Platform offers two account types:

• Parent Family Account: Created by a parent or guardian to manage a household profile, add children, record tooth events, and invite Gifters. A Parent Family Account requires a valid email address and password. A paid subscription is required to access the Full Journey features.
• Gifter Account: Created by a grandparent, relative, or family friend to participate in a child's tooth events. Gifter accounts are free and allow users to view event details, pledge contributions, and mark contributions as sent. Gifters see limited child data: the child's first name, avatar, and tooth event information.

Children do not have accounts on the Platform. All child-related data is managed by the Parent Family Account holder.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately at hello@fairymarketvalue.com of any unauthorized use of your account.

4. Shadow Ledger & No Payment Processing

FairyMarketValue.com operates as a shadow ledger: a record-keeping system that tracks the amounts associated with tooth events and contributions without ever processing, holding, transferring, or otherwise touching any funds.

• The Platform does not accept payments from Gifters on behalf of children or parents.
• The Platform does not disburse any funds to users.
• All actual money transfers occur directly between users through third-party payment services (Venmo, PayPal, Zelle, Cash App, or cash) entirely outside the Platform.
• We have no control over, and no liability for, any third-party payment services, their terms, fees, or transaction outcomes.
• The amounts recorded on the Platform are user-submitted and for informational and educational purposes only. FairyMarketValue.com does not verify, guarantee, or enforce any contribution amounts.

Because the Platform does not process payments, we are not subject to PCI DSS compliance obligations, and we do not store any payment card or bank account information.

5. Subscriptions & Billing

A Parent Family Account may use limited free features. Access to the Full Journey — including all 20 tooth events, financial lessons, and advanced tracking — requires a paid subscription priced at $4.99 per year.

• Subscriptions are billed annually through our third-party payment processor. By subscribing, you agree to that processor's terms of service.
• Your subscription will automatically renew each year unless you cancel before the renewal date.
• You may cancel at any time through your account settings. Cancellation takes effect at the end of the current billing period; no partial refunds are provided for unused time unless required by applicable law.
• We reserve the right to change subscription pricing with at least 30 days' notice to your registered email address. Continued use of the Service after a price change constitutes acceptance of the new pricing.
• Gifter accounts are free and do not require a subscription.

6. Prohibited Uses

You agree not to use the Service to:

• Violate any applicable law or regulation.
• Impersonate any person or entity or misrepresent your relationship to a child or family.
• Upload or transmit any harmful, fraudulent, abusive, defamatory, or otherwise objectionable content.
• Attempt to gain unauthorized access to any account, system, or network.
• Use automated scripts, bots, or scrapers to access the Platform without our written consent.
• Use the Platform to solicit or harvest personal information from other users without their consent.
• Interfere with or disrupt the integrity or performance of the Service or its infrastructure.
• Use the Platform for any commercial purpose not expressly authorized by us.

We reserve the right to suspend or terminate any account that violates these prohibitions, without notice or liability.

7. Content & Data

You retain ownership of any content you submit to the Platform, including child names, event notes, and contribution records ("User Content"). By submitting User Content, you grant FairyMarketValue.com a limited, non-exclusive, royalty-free license to store, display, and use that content solely to provide and improve the Service.

You are solely responsible for the accuracy of information you enter into the Platform, including contribution amounts. We do not verify user-submitted data.

We may use aggregated, de-identified data derived from Platform usage to improve the Service, conduct research, and develop new features. This data does not identify individual users or children.

8. Privacy

Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the data practices described in the Privacy Policy.

We take the privacy of children seriously. The Platform is designed so that children do not directly interact with it and do not provide personal information to us directly. Child-related information (such as a child's first name and birthdate) is provided by the parent or guardian. Please review our Privacy Policy for details on how we handle children's data in a manner consistent with the Children's Online Privacy Protection Act (COPPA).

9. Disclaimers

The Service is provided on an "as is" and "as available" basis without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

FairyMarketValue.com does not warrant that the Service will be uninterrupted, error-free, or free of harmful components. We do not warrant the accuracy, completeness, or usefulness of any information on the Platform, including contribution records entered by users.

The financial literacy content on the Platform is intended for educational purposes only and does not constitute financial, investment, or legal advice.

10. Limitation of Liability

To the fullest extent permitted by applicable law, FairyMarketValue.com and ChachKey.com, and their respective officers, directors, employees, and agents, shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Service, including but not limited to:

• Loss of data, profits, or goodwill.
• Disputes between users regarding contribution amounts or payments made outside the Platform.
• Unauthorized access to your account or data resulting from your failure to safeguard your credentials.
• Third-party payment service failures, fees, or disputes.

Our total aggregate liability to you for any claim arising from these Terms or your use of the Service shall not exceed the total subscription fees you paid to us in the twelve (12) months preceding the claim, or $10.00, whichever is greater.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by updating the "Effective date" at the top of this page and, where appropriate, sending an email notification to your registered address.

Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree with the changes, you should discontinue use of the Service and may request account deletion by contacting us.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the state in which ChachKey.com is incorporated, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved through binding arbitration or in a court of competent jurisdiction as agreed by the parties.
